DLA Appeal Question

OH has a middle rate care and lower rate mobility award. We appealed the Mob award with the help of the RNIB. Unfortunately Dr he's seen only briefly since his stroke wrote a one line report stating "he has a white stick he can use to get around" which has now encouraged the Tribunal to question his whole award. His diffuclties are more complex than blindness.
New evidence has been obtained from those he actually sees (no pun) and submitted. RNIB also want me to speak as a witness.
The question is around that I am very happy to speak to the tribunal but I don't particularly want OH in the room while I do. My evidence is factual and compelling but will potentially send him into a depressive spiral if he has to listen to me describing his difficulties in a graphic fashion. Can I ask to give it in private or can they insist that he remains?

tbh i`m not sure,but couldnt you submit your "evidence"in writing to the appeal?0

They have a statement from me but RNIB have advised they may wish to talk to me too.
I have no problem with that just think that if the roles were reversed I wouldn't want to hear my other half telling people about such personal things about me. He knows it's happening but there's a big difference between that and having to sit thro it. I think this is one you would need to ask the Tribunal Service about.
Sometimes witnesses just come in to give evidence and then leave but the claimant stays in the room for the whole hearing.0 -

I was wondering if anyone can give me and opinion. I have been in reciept of low rate DLA for 2 years. I am insulin dependent diabetic, have a frozen shoulder post trauama and depression. Over the last two years I had a breakdown started having daily panic attacks anxiety and have now got a psychiatrist and psychiatric nurse. I have recently recieved my award and they said I am not entitled to DLA at all. Ok I undersatnd their opinion but if I have had more probs now in past two years it doesnt make sense. So does anyone think I should appeal0

i think you should give it a go. a diagnosis isnt proof that you need care, its how your problems affect you. it's all in the detail. don't just answer yes or no to questions, you need to give details of why you need help.0

It's also worth getting help from CAB or DIAL when filling in the forms. Your local council will have welfare support officers who can help, both with applications and with appeals. If you are already suffering from panic atacks and anxiety, help in filling in the forms would be beneficial to you IMO.0
