Rented house - broken window

If tenants report a window has been smashed, who should foot the bill - landlord or tenant? I'd expect the tenant to pay.

If insurance is used, would this be the landlord's buildings insurance or the tenant's contents insurance? If the former, who pays the excess?

    Tenant if tenant broke it -landlord if flying football from outside!

    Window is part of building, not contents.

    Excess payment as above.
    Debt free 4th April 2007.

    What about old windows that "just break" because there so old. I am a tennant and if a window broke, that wasn't clearly my fault, there is no way I would pay for it. If LL didn't fix it, I would just move.
  • I understand that the tenant's kids broke it while playing in the garden.

    Quote is £320. My insurance excess is £100. The tenants deposit would cover it if necessary but then I'd have no deposit for other things.

    most insurance for tenants will not cover accidental damage

    therefore i guess this kind of thing is written within the tenancy agreement ??

    They broke it, they stump up for repairs
  • Might need to replace 'kids broke it' with 'found it broken' ;)

    Tenancy agreement stipulates that they repair breakages and need to insure for at least contents.

    Windows are usually much cheaper and I would normally repair one myself. Technically, I would expect the tenant to pay but the LL may just pay it out of goodwill - I would.

    In this case it was a 6mm toughened and double-glazed safety glass for a patio door.

    sometimes there are clauses in AST which say tenants are responsible for glass breakages.
