Wrong colour carpet?

Hello!

I brought some carpet from a well known retailer in mid march, by the time the room was ready for it to be fitted it was mid/late april so I called them and arranged fitting. The carpet was picked up by their fitter and brought to our house (I paid £35 for delivery). When he went to fit it is was too small by 10cm, after much kicking myself, I accepted that it was my error and re-ordered over the 'phone a new piece of exactly the same carpet the corret size. I thought that the wrong size carpet could go in the loft as it would fit in a bedroom when they needed replacing.

The new carpet took 10 days to come in and again the fitter picked it up and brought it to our house (on bank holiday monday). When he unrolled it was clearly a different colour to the first bit, it was a yellow where as the first bit had been a light cream. The colour is called 'Sand dune' so I assume that the second bit is the right colour. I had thought that the first bit was too light, but assumed that it was the light or something.

Anyway the fitter fitted the correct size carpet and I rang the retailer to point out that the first bit was the wrong colour. They said they would send someone to have a look and he came on Thursday just gone. He took a sample pf both bit of carpet and agreeed that they were a different colour.

I called the store today and was told that they had looked and that the colour difference was 'within tollerances'. I pointed out that it was not just a shade different but was a completely different colour. The manager said that he need to come and have a look to make a decision, even though he had the samples there in front of him. I told him that they had already sent someone round and I was not happy to have to waste another day waiting for him to come and have a look.

I paid on a credit card some have asked for them to send the paperwork for a charge back.

My questions are:

Am I right in thinking that I need to write to the retailer to reject the carpet and say they must collect it within 7 days?
Is there a timescale I have to do this within?
I have put the carpet in the loft (which was blinking hard work), is it down to them to collect it from the loft?
Is the law in this case simular to if I order something out of a catalogue i.e. I can reject it outright with in a certain number of days.

    If you wish to reject yes but this must be done in a reasonable time. In this case I dont feel it is as you must have known the second it was delivered it was the wrong colour. If you didnt it suggests your complaint is without grounds.

    No they do not need to collect it from your loft.

    Yes DSR gives 7 days although dont think it applies to your case.

    Overall I think if you ordered sand dune and they delivered sand dune you have no case. Colours etc will vary due to suppliers and so on. It was your responsibility to consider this and not theres.

    It really seems like you are simply trying to screw them over due to your mistake.
