Local Land Search

Hi, please could anyone advise on the above?

We initially agreed the Offer price on the house we intend to purchase on 1st March 2006. We have not yet been able to complete the purchase as our Vendor has had to apply to court in order to evict the tenants currently occupying their rental property which they intend to move to.

As we are not likely to complete until Sept/ Oct, our solicitor has advised that we will need to do another local land search at it expires after 3 months, in this instance around mid-Sept. Is this true and will we have to pay again to do another for the sake of a few weeks after expiry? Not only will this cost us, but will also add further delay…

Has anyone experienced such a long delay in a purchase? By the time we complete it will have taken approx 7 months, and there is no chain on either side of us and the Vendor, except their tenant. Had we known this was a huge mess from the outset, we’d have thought twice!! But typically the vendor or agent made out that everything would be straight forward.

    In a word YES. Searches take in things like planning applications, and, although unlikely to have changed, the lender will want a "recent" search to show that there is nothing which will adversely affect the value of the property they are lending money against. (Like a recent planning application for an abbatoir at the back of your house)

    it took me 8 months to buy a flat once, lots of issues about the lease caused loads of delays. Searches can take a couple of days or several weeks, it all depends on teh local authority concerned, and yes, you do have to pay for them again.
