afternoon all
i bought this http://cgi.ebay.co.uk/ws/eBayISAPI.dll?ViewItem&rd=1&item=6360235510&ssPageName=STRK:MEWN:IT and sent the payment straight away, but since i bought it on the 21st he hasnt replied to a single email, i also relised that it could be fake, by looking at his feedback http://feedback.ebay.co.uk/ws/eBayISAPI.dll?ViewFeedback&userid=bargainland2005 what should i do?

    sorry to say this but perhaps you should have taken notice of the feedback before bidding!! That is what it is there for!!

    You need to contact ebay, send him a formal email through them and start proceedings to do a chargeback through paypal! If it is all kosher in the end you can cancel formal proceedings!

    thanks for the reply, i bought the item before the feedbacks appeared about him selling fake dvds :(

    Region free and the BIN price almost certainly mean you are buying a pirate.

    However, although a week for delivery is not unusual if you are at all worried and are not getting any response from the seller then start the paypal chargeback procedure, that should be enough to get the seller to do something!

    He's sold an awful lot of stuff without having got any feedback yet, so maybe he is just slow to ship.

    His feedback really isn't that bad tbh. If you are worried then yes start the Paypal chargeback now. It probably is a fake, but I don't see why you shouldn't receive it from him.

    okay heres an update
    i got the dvd yesterday, opened it up, and it is a fake
    1. teh dvd cover is cleary a fake
    2. the actual dvd cover is also fake, as the colours dont match
    3. on the underside of teh dvd it says "Carfield" LOL

    okay im gona try and get a refund, should i go striaght to teh seller or ebay or paypal

    The 'official' advice would be to email the seller first to ask for a refund, give him time to sort it out. However, this does give him the opportunity to clean out his paypal account to stop any chargeback. Although he might be willing to sort things out amicably especially as he has started to get negatives.

    However, the option to go straight to paypal for a refund is there, although as you have received the item it won't be very straightforward as you will have to argue that the item is not as described, which looking at the auction is probably not true.

    Although it doesn't help you get your money back you might want to turn him into ebay for selling pirates, they tend to frown on that sort of thing.

    Sorry to follow up my own response!

    It might be worth re doubling your efforts to get this seller banned. He is selling another DVD at the moment which looks dodgy and he has left some rather abusive feedback which is another point against him as far as ebay is concerned.

    If he gets NARUd he can't leave you feedback.

    Looking at his closed auctions though he is unlikely to carry on selling for much longer, he barely had any auctions closing with bids so his profit margin must be virtually zero taking into account his listing fees.

    is there any conseqences that mite occur from the seller once he/she/heshe finds out i have done a chargeback?

    i just read this on the paypal site , as im about to file a claim

    If you are filing a claim because you received fake or inauthentic merchandise, please be prepared to submit a letter of inauthenticity from a reputable expert who can substantiate your claim. This letter should be on official letterhead and include contact information so that we can discuss your case with the expert if necessary.
