Hi
I am looking for advice on the forum post below
Someone said I should try here
Anyone any idea what I would be entitled to from breakdown company for negligence ?
I am hoping for repair of damage to panels without having to claim on my insurance and pay an excess and risk higher premiums in future
Any ideas gratefully received
Thanks

sounds like rescue my car did'nt ask the local operator to uplift and store the car until recovery home.
i am confused by this. how far away was the hotel from your home?0 -
Was any paperwork filled in/signed at time of original breakdown, ie a vehicle condition report?ANURADHA KOIRALA ??? go on throw it in google.0

Hi breakdown was 400 miles from my home
No condition report was filled out by breakdown truck that originally trailered it and us to hotel"Very funny, Scotty. Now beam down my clothes."

They might argue that it was not in the breakdown companies care it was in yours at the hotel you were staying at. They picked the car up as soon as they could and it was damaged before collection.
I would be phoning the hotel to see if they have camera'sCensorship Reigns Supreme in Troll City...0 -
ok the first breakdown operative should have filled out a vehicle condition report and you would have signed it when the car was loaded and unloaded failure to do this leaves them open to all sorts of damage claims.
its not uncommon for long distance recoveries to be stacked up untill there are 2/3 cars heading the same way but these are handled by the recovery operator not rescue my car it would appear that rescue my failed to instruct an operator to recover the car for safe storage and onward travel.
i would put in a claim to rescue my car then they will start an investigation into the incident0 -
Ok
Will contact hotel re cameras
First operative did get us to sign off a sheet when he off loaded it at the hotel, there was no damage noted because there was none at that point. They might argue that it was not in the breakdown companies care it was in yours at the hotel you were staying at. I agree it may have been in our care the night we stayed there
However it was a one night stop over and they did promise me that it had been moved Friday morning shortly after we left in a taxi :-(
There was no damage when we left"Very funny, Scotty. Now beam down my clothes."
