Deposit held by DPS - landlord will not respond?

as soon as you get into getting Stat Decs signed - it is my understanding that you are then in the terriroty of TDS Arbitration Sche,e
the 3 Schemes seem to have set upa their processes as Arbitration as the default system and sometimes it is not clear how to opt out of Arbitration and go to court...
i have waited 6 months for a deposit back From DPS rean absconding tenant who did not respond to any of the DPS requests for responses....0 -
hi - can anyone assist or give me some info - any help would be greatly appreciated - i have been served notice as of today at a property i've been rentng for nearly two years. a deposit was paid in october 2008 tho at the tme i was unaware of the deposit protection scheme - i have not received a certificate and have so far contacted one of the three government bureaus resonsible for handling the deposits who cannot trace the rented address. when asked today - the landlord stated i hold your deposit and you won't be getting it back. can i apply via a solicitor straight to the county cour for a remedy. my landlord is due to sell the property and has been tarting up the property giving labourers access and keys to the property without my consent furthermore i've had about three hundred vinyl records damaged and warped due to damp and a cheese plant inadvertenty snapped in half by a gardener - it is dead (as was two years old 5 foot tall). landlord has been very threatening and even brought members of his family down today to lay seige to the property making various threats in public - all of this was recorded on an i-phone. as said can anyone help?
