Carcraft /barclays finance nightmare!

Hi,

I am really hoping someone on here will be able to help us!

We took out a finance agreement for our new car with carcraft almost a year ago. When we took the agreement out we were told our payments would be x amount over 3 years. We signed all the paperwork and drove away that day.

When our paperwork came through the post from Barclays (they provided the finance) the payments had stayed the same but were set up over 4 years. We immedietely called carcraft who said there had been an error with their paperwork and could we go sign new papers. We drove 30 miles at a cost to us and signed the new paperwork.

We then recieved a phone call from carcraft to say they had no finance agreement for this at all and did we have a copy. We advised we did but wanted to know what happened to the 2 we had already signed. We were told an admin error had been made and no copies had been kept so could we go and sign new paperwork yet again.

This had now been going on for around 6 months, we went and signed the new paperwork.

We then recieved a phone call from carcraft to say that they had failed to take any proofs of address and barclays would not set up a new agreement without them. By this point i had reached the end of my patience and told them to stuff it basically, we also couldnt provide any proofs of address as we had now moved and so they wouldnt be valid.

My partner has spoken with barclays on numerous occassions and they have said that they have refused to set up a new agreement and that they were just waiting for carcraft to pay off the old agreement and that would be the end of it. They confirmed 3 times over the phone that the agreement was being paid off in full by carcraft and that it would be removed from our credit file as soon as this happened and we wouldnt be liable for it any longer. We were told not to pay anymore on the finance and ignore any letters which were sent.

This morning we have recieved a letter from a debt collection agency stating we owe them the full amount, when we have called the barclays department dealing with this they have said they can no longer speak to us regarding it as they have nothing in writing?

Does anyone have any advice with regards to who i can complain to or what to do?

I havent written down any of the dates or anything so not sure if i can make a formal complaint?

I had a bad experience with these fascist pigs!

Seen a car, applied for finance and instead of only conducting one credit search they conducted over 20! I am in the process of seeking legal advice against not only Car Craft but also the finance companies as I should have been contacted due to the fact I have a password protected credit file(s) and in the event of any credit application it must be authorised by me. Not one of the finance companies contacted me so not only are they in breach of the DPA technically it is application fraud as I did not authorise these searches. Subsequently I did not get any finance due to the fact they cooked my credit files with searches.

My advice to you would be to seek legal advice with scope to taking legal action.

Since when has the world of computer software design been about what people want? This is a simple question of evolution. The day is quickly coming when every knee will bow down to a silicon fist, and you will all beg your binary gods for mercy.

I can understand why you are upset, but they probably did you a favour by saving you from ending up with a sub-prime loan at stupid APR. Car Craft have a bad reputation here, too. You are better saving up and paying cash to a reputable dealer.

So you signed 2 lots of paperwork? What was the difference between the two? If the term wasn't what you thought you'd signed for, was the payment recalculated once the term was corrected?

Carcraft use mainstream lenders initially, so if you are a good risk, then your loan will be with the main lenders at standard APR's.

As per the OPs agreement - Barclays dont do subprime lending.

The first lot of paperwork was set up over 3 years but when our paperwork for the finance came through it said 4 years. Carcraft have no copies of this original paperwork at all and said it must have been sent across to barclays incorrectly so we had to go back and sign new copies of the paperwork again over 3 years. From what I can see they have lost out on money because they have kept the payments exactly the same and lost out on a years premiums and interest?
