potholes

hi im posting for someone else and im not too sure where to put this but here goes.. if a pothole has caused damage to a car,relevant pictures taken of the holes,road,damage to car etc and sent off to relevant council, then what would be the next action to take if a letter has arrived saying that the road was checked 2 weeks before the pothole appeared all was fine no holes etc and even though they have now filled in the hole they do not have to pay out with their insurance because the road was checked in accordance with their policies :o i hope this makes sense lol,

    You have a fight on your hands. There was something about this recently and basically you wiull have to prove that they weren't checking the potholes (think it was Channel 4 Dispatches, on insurance claims and scams)

    Hmm not sure, I once hit a very very dangerous pothole it was huge took the pictures of the crater along with the damage caused and sent off an attached letter along with photos taken almost a month later showing it unrepaired. Paid out no problem.

    I see what they are saying as they can't be expected to repair a pothole as soon as it starts to form but you should argue your case, saying something like while the road may have been checked it is evident from the scale of the pothole that it has been forming for considerable period of time as such it is highly likely that it was there when checked and was just missed during the check. Best thing to do is quote the legislation about their duty to maintain the roads etc. Good luck anyway :)

    it is evident from the scale of the pothole that it has been forming for considerable period of time as such it is highly likely that it was there when checked and was just missed during the check.

    We have a bad corner near us which takes a battering from HGV vehicles and I have seen a pothole go from nothing to huge within a few days.

    I agree have seen this happen myself, point being for the OP to try everything they can and argue their case, as even if a pothole forms that quickly it is likely to be caused by inadequate materials or construction techniques that are insufficient with dealing with the traffic on the road.
