Zavvi - Undelivered t-shirt (£3)

Hey,
I purchased a £3 T Shirts back on 24/12/09 from Zavvi, and it never arrived. I haven't chased it up until now because it was so cheap.
They have informed me it was despatched on 30/12/09, and they would not be able to refund or replace as I hadn't reported it to them within 40 days.
It's not the money value that bothers me, just the fact they can get away with it.
Anything I can do?

You could ring your credit card company and see if they can do a chargeback! I don't think it's right that they should set a limit on something not turning up, unless this corresponds with a royal mail limit?0

well to be fair,its been 5 months
you could have work the T shirt out by now
i dont know the legalities but im not surprised on them doing this
BTW you cant chargeback under £1000 -
