Advice on Lloyds / Moorcroft

  • Hi there, they tend to sell debts from one dca to another, so it doesn't surprise me that a new one is involved. I think you need to send the above letter (account in dispute) as Lloyds never sent your CCA as requested. Until you receive your CCA, the debts cannot be sold on & they also cannot be chased according to the OFT. Hth

    If all else fails, try and get them to pass the debt onto there inhouse dca, BLS Collections. All's I can say is, after fighting for years with Lloyds, this was the only way I got them to stop all interest and finally start paying off the debt.

    But for now, I would keep down the route you're going, make sure they supply you with the CCA. As long as you've paid the fee, and requested it, as far as i'm concerned, they have to supply it.

    No. The info request's been sent and the company is aware it's in dispute - you need not deal with this company at all.

    Needn't keep contacting Royds. Every time Royds or a new DCA gets involved and it doesn't concern what you've previously asked for, report everyone concerned to the OFT and the Financial Ombudsman Service.

    If they've defaulted on the time limits, then they cannot enforce anything, and nor should they be contacting you until you get what you've asked for.

    No. Every attempt at contact they or any of their companies have made once they defaulted on the CCA request should be reported as separate complaints.

    If you do it online, then save the first one as a template, and change what you need to on the rest.

    We sent the original CCA request and follow up letters to M-croft as they were dealing with the case at the time. We have letters from M-croft confirming that they had requested it for Royds.

    Royds are now giving the impression that they have never had a CCA request from us through M-croft, will I have to start this process again or will the letters I have copies of along with recorded delivery proof of receipt to M-croft be enough to confirm Royds have defaulted?

    The advice from everyone is very helpful and much appreciated.

    If you have copies of proof of delivery, retain them. It's not up to you to do Moorcroft's work for them, and nor should you provide any help to either company.

    Moorcroft received your request, and as such, they should have actioned it with Royds - if they haven't, it's not your problem.

    Once again, every time Royds or any of its agents does collection activity of any kind, keep referring the matter to the OFT and the Financial Ombudsman Service. This creates cost and time for the parasites involved.
  • Royds have now sent to me several pages of screen captures from some program with transactions on it. It is not very clear as to what it is but does not show anything after last April, about the time I requested the CCA.

    On the bottom of each screen capture it does state:
    Uncleared balance 0.00
    Cleared balance 0.00
    Outstanding balance 0.00

    And the last entry shows Write-off:W (cant read the rest as it is off screen).

    As this is not a CCA and I am not sure what is it for, I am going to ignore it. I await the CCA from Royds.

    Can you please point me in the right direction to the complains forms on the OFT site as I can not find them.
  • All has been quiet for some time until I started getting calls from a company called wescot a few weeks ago. I updated wescot with the information and the fact that they should not be contacting me as there was a dispute with the account.

    Last week I received a letter from them saying that they would be investigating the matter and put everything only hold. Today however, I have received a letter from wescot stating that I need to contact Lloyds directly and request the opening agreement with payment of £1. As I had requested the CCA through M-croft some time ago and received a letter back from them stating that, after they contacted Lloyds, were unable to provide said document, what should I do next?

    This is the 4th company that Lloyds have contacted me through and they have still been unable to provide the CCA as requested when the first company (m-croft) contacted me. They must be running out of companies to try.

    I did call wescot and told them that I would not be contacting Lloyds again as I had already made the request once and not to contact me again until the documents were provided but they informed me that, as lloyds had asked me to request the CCA, they wound not close the matter.

    Sorry about the long winded explanation about what is happening but it is very worrying that lloyds appear to ignore the fact that the CCA had been requested over a year ago and continue to act this way. Any advice on how to deal with this situation would be appreciated.

    Did you send the "account in dispute" letter to Wescot?

    Your cca request remains in default. It's not down to you to keep requesting it and sending £1 each time.

    Wescot? - seems they are scraping the bottom of the barrel...:D

  • Hi thechippy, thanks for the quick reply. I have only sent the account in dispute letter along with the previous 2 ( CCA request and reminder) to the first company that contacted me. The second and third companies accepted my verbal dispute and returned the matter to Lloyds.

    It appears Wescot are not accepting this and have tried to make out that Lloyds would be happy to provide the CCA on receipt of a request and payment. I dont want to do this as it would start the whole process off again.
