DLA 404 exemption form

hi just a little advice please, i currently have our family car,, but its in my wifes name as PLG, if i apply for the tax exemption (dla 404 ) in my name as the dla claimant, does that mean that we have to change the car taxation class over to Disabled, or can it be left as it is?
we both drive the car

  • When applying for road tax exemption using the DLA 404 form, the taxation class of the vehicle will be changed. This application would need to be made at your Vehicle Registration Office, and cannot be done at the post office.

    The main disadvantage is that the vehicle should be for the benefit of the disabled person. It's a real grey area, as the wife going shopping, could be deemed as 'for the benefit' but say would the school run?
    It only takes an over zealous traffic warden or disgruntled neighbour to take issue, and you would need to justify your position.

    As you both use the car you would have to explain, if asked, why you for example took the car to work and left your partner at home without the car?

    You need to take all docs once you get them plus your mot, insurance etc to the DVLA office to get a new tax disc

    The advice I received from Motability (because the DVLA refused to advise me) was that in the case of a primary carer using the car to get to work etc this was fine because, if there were a problem, the carer would need to be able to return as quickly as possible. Re School run, that there is a legal responsibility on the parent to get the child to school and the getting the child to school is therefore a need of the parent.

    The taxation class will definately have to be changed, The DLA 404 form is no longer available to people who request a new one after it is fully filled in, the DWP are sending out letters with an entitlement for taxing one vechicle instead of the usual form that allows people to tax more than one vechicle if they want to defraud the system. they include the registration number in the form they send out so that it can be registered online in successive years to re-apply for a tax disc online.

    what I have now realised recieving this new letter with the registration number is that I no longer have the DLA 404 for which was a "certificate of entitlement to disability living allowance" Not just a form for applying for a new free tax disc. this DLA 404 I needed to present to apply for a blue parking badge and any other consessionary offers for example a concessionary fishing license.

    I have now writted to The disability Living Allowance People asking for a new DLA 404 "Certificate of entitlement to disability living allowance" even if it does not have the section on it to apply for a new tax disk.

    This once realised may well affect a lot of people who used the DLA 404 to proove entitlement to Disability Living Alowance because it lasted several years in succession, it may well be that we shall now have to keep asking for a new up to date letter of confirmation of entitlement to satisfy applications that require the old certificate of entitlement, which will create more paperwork for the DWP. Why they must regard everyone who uses the old DLA 404 form as someone who may commit fraud and tax more than one vechicle puzzels me to say the least.

    as long as you remember to display both halfves of your Blue badge when you need to use it (which is a legal requirement) you should be ok, no-one ever seems to read the rules.

    you will be required to fill in a form when applying for a tax disk there are two statements.

    1) the vechicle will only be used by the disabled person.
    2) the vechicle will only be used for the disabled person.

    you will be asked which statement applys to you (probably the second one) if someone else is to drive the car for you, if you have a named driver for the vechicle on the cars insurance policy this will help to show that the car is used to transport you around. the wifey could find herself in trouble if she was to go out alone in the vechicle and use the blue badge if she is not disdabled as said above it is a very grey area, the rules /regulations must make reasonable adjustments for families who only have one car and more than one driver in the family.
