bank charges

Advice please. I wrote to Bank requesting refund of charges. Got the expected "no go" response. Wrote back saying would contact FOS. This was about two weeks ago but have had no response. Should I wait a further time or write again??????????

    What was the response of the bank?
    I have not worked for NatWest Bank since February 2009

    Was the response you got from the bank their final response? This used to be made clear by the use of the term 'deadlock' , but they don't laways appear to use this nowadays and simply state it is their final response.
    If you haven't waited for this (or the 8 weeks allowed for the bank to resolve the matter has not otherwise expired) then the FOS won't help you but simply refer you back to the bank.

    What was the basis of your argument? A legally based challenge or one of personal financial hardship? The FOS will not consider claims for cnak charge refunds based on legal arguements since the banks secured their court victory in The Supreme Court last November.

    Presuming a valid claim that meets the FOS criteria was made, then you'll have to wait a lot longer than 2 weeks I'm afraid. The FOS say they aim to resolve most disputes within six to nine months but that they settle a third of cases within three months.

They say in their letter "if you respond to this letter (which I did on 19 April) and we are unable to come to an agreement we will provide you with details of the FOS should you want them to consider your complaint independently".

    The reason for trying to get back bank charges was because we are in severe financial difficulties and that would be the argument we would use with the FOS.

    Should I ring and ask for an acknowledgement of my second letter? I did send it by Recorded Delivery and have confirmation that it was delivered and signed for.

    How did you argue financial difficulties?
    Did you provide evidence of what caused the financial hardship and how the charges made that worse?

    I argued that we were in arrears with mortgage, utility bills etc and were having problems paying to live. We did provide evidence of what caused the problems and how they were making it worse.

    I still have not had an acknowledgement to my second letter stating that if I did not hear from them further I would be getting in touch with FOS. Should I write and ask for an acknowledgement.

    The Halifax who are, from what I have read on this site, probably one of the worst for refunding!!!!!! I'll keep trying.

    The letter did not say it was final only saying "as a result of these rulings we won't be upholding your complaint or providing a refund of the bank fees that you've complained about", but as stated in an early post they said "if you respond to this letter (which I did on 19 April and they received it on 21 April) and we are unable to come to an agreement we will provide you with details of the FOS should you want them to consider your complaint independently". So what should I make of this?
