Have you got any proof that you lent them the money, paper drawn up between you, otherwise it could be seen as a gift.

Where bounced cheques are concerned, this is irrelevant. The claim is not for a debt action, or breach of contract, but for a dishonoured cheque. The proof is the bounced cheque itself.
The reason is that once someone gives you a cheque they can't take it back. It is like them giving you the cash and then robbing you in the street and taking it back - at that point the claim wouldn't be about whether not not they owed you the money in the first place, but about the subsequent robbery.
The relevant law is The Bills of Exchange Act.
Unfortunately, if the friend isn't worried about getting a CCJ, or if they have no money or assets, then there isn't much chance of getting the money back, even if OP goes to court.I'm a retired employment solicitor.
