Please can anybody help.
My Husband is currently paying CSA payments for his Daughter who is 19 in June. We have recently found out that she has left College early and has flown out to Greece on the 30.04.10 for 6 months. The CSA have contacted PWC and she has told them that she leaves College 14th May. We have gathered so much information on her flights, where she is staying etc, but the CSA are telling us that they have to take their lead from Child Benefit, who willl be paying Child Benefit until 7th June.
We are so frustrated, why should we pay when the Child is now not living with PWC - she is blantantly telling the CSA incorrect dates to be able to carrying on claiming CSA and Child Benefit Payments.
Any help would be so appreciated.

Take this further with CSA, send them the evidence and demand they act upon it, I know in some cases CS liability is not reliant upon child benefit. It may be true that dd official leaving date from college is 14th May, but if she's in Greece for 6 months and not attending then surely you have a case. Also, I know that in some cases child benefit is paid for a period following completion of college, but others will know better.
Our PWC doing something similar, no child benefit paid to her since September 09 for daughter aged 17, so CSA closed case. They wrote to PWC in January 2010 to inform her case closed. PWC contacts CSA and informs them 'she hadn't realised' she had not received child benefit, child tax credits or working tax credits for 5 months, so guess what??? She gets daughter to enrol on college course, has child benefit, child tax credits and working tax credits back-dated as she lied and said daughter had been studying since September, and hey presto CSA liaility continues - result eh!!!!!!!!!
It's a sham, you could also try reporting her to Child Benefit Office for fraud, and send them the evidence0 -

Maybe the PWC in your case is financially secure because I would know if I missed only one payment of child benefit never mind C/T and W/T. How would you not know for 5 months??0 -

Surely if there are two conflicting stories the csa would have a system where by they investigate ie get confirmation from college that the child is still attending the course, to just believe one story over the other is ignorant on csa part.
Maybe thats what you could do, get confirmation from college and send copy into csa to back up your story, send it recorded delivery and ask them what do they propose to do with the information you have sent to them and let them know that you will be following up this case until it is resolved, holding them responsible for any inconvienience if they dont act on the evidence that you are providing.
Good Luck!0 -

Well, seeing as our PWC is demanding the 34k 'arrears' CSA have incorrectly calculated from me, and wants it asap!!!!! We have Tribunal date next month, and I have proven this figure is not owed. Who knows how she is financially.
BUT..............As you said, I have 2 children in my household who are 15 and 4 years old, and my wife and I would definitely know if we missed 1 payment never mind 5. Also, as PWC was/is claiming work tax credits ........could it be that she is 'living with a prtner' but not declaring this, as how else could she not notice 5 months worth of benefit payments - definitely a fish away somewhere0 -

I wish you luck with your tribunal and hope you have got all your evidence to throw at them.0 -
bdt1 - 34K! Have you enlisted the advice of NACSA regarding your case? Or any other professional body?0

In our experience the only information that the CSA take into account is that given by the PWC, and any other info they forward to the PWC and get the PWC to confirm it is correct anyway, so if the PWC disputes the info then their word is the one taken despite any evidence to the contrary.
I wish you luck, but don't think you'll get far!
I think I would just be thankful that she will be 19 next month, and you can stop paying!0 -
Yes NACSA involved,0

The finish date quoted by the PWC is 15th May.
By going to Greece on the 30th April, she is effectively having 2 weeks holiday, from college, regardless of how long she intends to stay away. There is nothing unreasonable there.
Child Benefit will then stop on the 7th June, presumably the next payment day, after the quoted finish date.
My son finished college at the start of December, but Child Benefit was paid until the 1st March, and I kept the benefit office informed to avoid over payment.
So it is wrong to assume that the PWC is manipulating dates.
