Afternoon all
I need some help as I cannot get hold of my landlord.
I had a letter sent today (addressed to the occupier/tenant) that reads as follows:
Dear sir or madam
Our client: Bank of Scotland
Borrower: Mr **********
Property: ****************
We are instructed to act in re-possession proceedings relating to the above property and have now received a date for the hearing as set out below.
Name and address of claimant: Bankof Scotland
Name and address of Defendant: Mr ***************
Court Name: *********
Court Date 1st June
If you are named as defendant you may ignore this notice as you ill already have been notified, but youshould draw attention of any other occupiers or tenants.
I am worried sick. I have had not had any letters and my landlord hasnt mentioned anything.
Does this mean I have to move out by 1st June? Will I get my deposit back? (AST agreement dated 1st December 2009)
I am devastated x

The hearing will be 1st June. I advise you to go. The court will give you time to move, but yes, I'd start looking.
Assuming your deposit is lodged (as it should be) in a deposit scheme, it is safe.

Do you go through an agent for renting? Call them straight away if you do, they may not know anything about the repossesion yet.
If you are paying direct to the landlord, I would stop the direct debit until you hear from him. Your deposit should be safe, but only if he protected it. Did he give you proof that it was protected soon after you moved in?0 -

He probably had a mountain of debt, not just the mortgage. You should check your deposit is safe before you pay him anymore money.0

Check your deposit is secure. If necessary, contact each of the schemes yourself to check here.0 -

Let them know you exist.
Attend the court case, take your rental agreement with you.
The court case is just the first stage. After that there's more time before you get a leaving date.
CANCEL YOUR RENT TO YOUR LANDLORD until you know what's going on.
Check if your deposit is protected.
Are you on an AST? To what date?
Or periodic, what was your moving in date?
You certainly have a couple of/few months before you have to move out, if your landlord doesn't get his finger out.0 -
All the schemes are closed so its going to be Tuesday before I can check.
My AST was started on 1st Dec, the review is due 1st May (Sunday?) Rent is always paid on or around the 1st, so I have paid April rent this week due to the bank holiday.
I'm just gutted as I've spent money painting and decorating. He must have known before I moved in.
I won't get any help from the council as I work and have only lived here a few months.
I've got a relative I can move in with, but she is 20 miles from work (no car now). I won't pass a credit check either with a letting agent:(0
