Advice please

Hi there,

I purchased a kitchen on my credit card as supply only. In fitting the kitchen we found two broken cupboards so took them back as damaged to the company who exchanged them no trouble. On the last stages of fitting the kitchen (3 months later) it was time to peal off the protective layer, everything was ok with the cupboards but one of the worktops was damaged. You could not see it under the protective layer at all, we had checked all the items on delivery.The company did work to the worktops for us by cutting them to the correct lengths.

I spoke to the company about the damage and they gave us 2 options pay for a new one or they would give us a tube of color fill?

Do i have any rights the company say their terms of business state damages have to be reported within 7 days?

    I think you might struggle to get it replaced FOC as you've chopped it up....especially after 3 months. Is the damage in a prominent position or is somewhere near a place that's going to have a kettle/toaster/biscuit barrel sat on it?

    The only way this could go in your favour is if you can prove the worktop was damaged at the point of delivery...
    If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

  • Yes the damage is in a prominent position along the front edge it was under a layer of thick plastic and it also had plastic edging strips over it. I think it came out the factory damaged or when the company we bought it from cut it, they drop the sheet damaging it.

    If it was bought new and it is damage surley it's not fit for purpose? Does it not come under the 6 months sale or supply of goods act?
