It is very difficult for the courts to force someone to leave or sell their own home, if the husband won't sign and the ex-wife won't or can't pay him off then yes this will go on for months, or possibly the sale will fall through entirely. Your lender will not agree to you completing, and your solicitor will therefore not either, without vacant possession. This document is presumably the husband guaranteeing he will go; if he then does not leave when you complete it will be relatively easy to evict him through the courts using the Notice.
