Sony not playing ball

I bought a camcorder in March from Sony online and used my local store as a reference point.

It was a £1500 camcorder than was on a half price at £749 + delivery.

It arrived on 17th March and was all fine and dandy. The battery lasts for 54 hours or so and i use it every day, sometimes just for an hour or so.

A week ago it was time to charge the battery for the first time since using it and upon plugging in the ac adapter it was telling me to reinsert or to use another adapter. Surely it can't be broken within this short period of time. It was.

The adapter had a chip missing out of the edge and the pins in the camcorder were bent.

Sadly, Sony don't make this model any more, but was willing to exchange it if they could find one, they cant, so i was told it should be a like for like model, which they are not willing to do.

Can anyone help advise please.

Andy

You bought the camera for half price in a sale so no wonder you'd like a replacement rather than a refund as you might struggle to buy the same camera for the same money now. However, if they want to refund you then there is nothing you can do, that is a decision for them and you cannot insist on a replacement.

If they offer you a replacement, you can reject it if it is not as good as the product you originally bought. But then they'd probably just offer you the refund instead which I am guessing you don't really want.

P.s. Bent pins and damaged adapter usually points to user neglect? But as Sony did agree to try and replace without argument then I'll assume its not the case this time.

OK, so they can't replace it, what other remedy have they offered?

This may not strictly be true, the OP may be able to sue for "loss of a bargain" as you say, a similar camera will be impossible to buy if a refund is issued. This means that sony should put the OP in a position similar to where they would be if the breach of contract causing the loss had not occurred. I.e with a working camera with similar specs.
    Back by no demand whatsoever.

Correct me if i am wrong but loss of bargain is:

"the inability to complete a sale or other business deal, caused by another's breach of contract, intentional interference with one's business, negligence, or some other wrongdoing."

So the OP could only claim loss of bargain if another company were offering a similar deal which has now finished.

Im not sure, i was under the impression it may apply. You may well be right, im no expert on loss of a bargain but was wrth a try:)

Apparantly Sony stores are franchises so they can only get stock from their own stores in each chain.

2-4 weeks on the next model up, so looks as though i may have to stick with this semi broken one for that long before it gets replaced.
