housing problem and legal aid

The housing benefits stopped out housing benefits for 2 weeks without telling us, when we asked why they said they did not know the reason, which is not good enough. They actually owe us nearly £200 but dont want to pay up. When husband was first laid off work he over paid extra month council tax and rent. The housing first said if we wrote in they would refund this to us. Now they said they used our money to pay our two weeks arrears on our housing benefits which is their fault they stopped it not our. Cause we have been claiming JSA since February and we have had so much mess ups since then. We keep getting told different things.
Now we have approached a solicitor as we have just had enough. We feel they are stalling cause they dont want to pay us our money they owe us, which could certain help us through bad times for a bit.
The thing is. My husband has been out of work for a long time now and he will be starting a job soon. But obviously I wonder if we can still claim for legal aid cause we dont have the money to pay a solicitor. He starts work on the 10th but at the moment we are still unemployed until that date.
Can we still claim legal aid or not? If not then we are stuffed basically and they have won and stolen our money. As we are the little guys as it were, we have no chance fighting them for our money without legal help.
