Kettle bought on 21/3 consumer rights

Hi Guys

A lady my mother cares for whjo is 76 and crippled with arthritis bought a new kettle from comet
She filled it enough to boil a cup today (she got took into hospital shortly after buying it), realised the kettle is far too heavy for her to lift. When I took it back they said "purely as a goodwill gesture" she could come and chose something else. I don't think this is right, and should be entitled to a refund.

What are her rights?

    The kettle does the job it is meant to do and unless you were specifically sold it on the basis she could it use in her condition and it turns out that this is wrong then they do not have to refund as it wasn't mis-sold and isn't faulty.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    I agree with CIS. What is this lady going to do for a hot drink if she hasnt got a kettle? Surely she will still need a kettle and I know Comet to some smaller and lighter ones which would be ideal.

    I think Comet offered a very reasonable solution even though they didn't have to. Your mother might want to consider getting a travel kettle as these are generally very small and very light.

    Point is they could of quite easily given her, her money back. They're just being awkward. She wasn't to know her arm would seize up and go into hospital.

    They could just as easily have said no too, perfectly legally. They were just being nice.

    Especially given that it's over 28 days since purchase. More than reasonable. I assume she will still need a kettle? You could swap for one of the hot water (e.g. Breville HotCup), which she wouldn't have to lift to pour.
