Benefit overpayments

Hi, i have benefit overpayments of £28,000 and housing and coucil tax overpayment of £8,000.
I am deaf and was claiming whilst working. They agreed there was a misunderstanding on my behalf and have asked me to pay it back, This was 2 years ago and I havent made a single payment yet.
I have been made redundant twice in the past year, I have 2 children and another on the way. My partner is a teacher but my debts are so bad we have had to leave our rented accomadation and move in with her parents.
The plan is to save for a mortage that she would get in her name as I wouldnt be able to...(bad credit!)
I owe in the region of £40,000. I am at the end of my tether! Should i declare myself bankrupt? I wish to go to uni next year, would it effect my chances of getting student loans? will the DWP prosecute me if I declare myself bankrupt?

That means you could still be prosecuted.
JCP = Jobcentre Plus.
Why do you think you should go bankrupt? Do you think you should not pay them back?

From personal experience I know that the Consumer Credit Counselling Service will definitely be able to help you.
They will go through a budget with you to establish how much spare money you have left over each month & help you make arrangements with your Debtors for affordable repayment scheme (sometimes as little as £1 per month).

I'm not 100% sure but I think that benefits overpayments aren't included in bankruptcy so you would still have to pay them back even if you did go bankrupt.0

I would like to think that's true, but even if it was - it still wouldn't take away the criminal aspect of it and I'm sure they could still prosecute in blatant cases. But.....again, would like to think that any kind of fraud is not incuded in BR.0
