Guys, got an ipod for our son after passing his GCSEs last year, all ok for 4 mths, LCD screen failed, no damage or abuse whatsoever, Apple refuse point balnk to repair it despite serveral phone calls and final letter before going to small claims court.
Even our neighbours sons pod gave up with same screen failure after 6 mths, and doing more research even more of their friends!!
So court it is.................................what a crowd of disingenious people they are!
Apple...their products....their staff.....are rubbish!!!!!!!!!!!!!!!!!

Why are they refusing a repair? Is this the shop or Apple online?0

Its their online store, but all repairs are dealt with through their European repair centre in Holland.
Ipods are sold with a manufacturers "limited" warranty with rules out any repair to the screen if THEY state its due to abuse or missapplication...........but theres no evidence of damage etc and son adamant its been carefully looked after........................
Nevertheless this doesnt affect your staturory rights as to "fit for purpose" sales blurb..............................court here we come!!0 -
Definitely, without a shadow of a doubt, go ahead with your County Court claim. For the screen to last 4 months is beyond ridiculous. I'm 99% sure they'll settle it out of court before the hearing.
It is a disgrace, though, that Apple are behaving like this.0 -
Having asked around, there now turns out to be several of my sons friends and neighbours whose ipods similalrly failed, so much so when they go back to school shortly they will put up a notice asking for owners of failed ipods to contact me, nothing impresses a judge more than a string of complains with very similar problems!!

Just thought I would add, my work colleague has had her Ipod Nano for about eight months and has just mentioned to me that her screen has also gone blank. Same as your son - well looked after but failed anyway. She was wondering how to go about getting it replaced so I said I would look on here to see if anybody else had a similar problem and for advice what she could do.0 -

In Saturday's Gaurdian there was an article on this which more or less said if you're persistant enough and say the right things you may get a result from Apple - here's the link:

The jist of it is that although the standard warranty is a year, sale of goods act supercedes the warranty and the item must last a reasonable amount of time.

If you got it from a retailer in the UK then the responsibility is with them and not Apple. Take it back to the store and get them to resolve it. As I understand it, if the product is under 6 months old, then the store should assume that it was faulty at the outset. But then, I am no expert.0

The OP bought the iPod from Apple's online store - therefore Apple is the retailer, in this case.0

Which Ipod is it? The Nanos have a known design fault and Apple will replace the first gen ipod nanos. I can't find the link at the moment but call apple support use their sales line (free 0800 number) and transfer to customer relations.
Apple are quite good (at the end!) of fixing their flaws, I had my powerbook motherboard replaced for free as part of their 'quality' control programme.0 -
Guys, I phoned them, written to them, giving 14 days notice of court proceedings, sent the item back twice.....no exterior damage, not been dropped, sat on or put in a school bag......they refuse to repair or replace.
They insist its been abused...small claims courts here I come.....:(......any one know if they make a counter claim within the samll claims court system, am I liable for all their costs - say if they send over two engineers from USA...all expenses paid?...:(
Not looking forward to this!!0
