Advice needed please - finish work tomorrow

Hello,

I was given 3 months redundancy notice on the 26th Feb (my contract stated 3 months notice was to be given), however I am leaving early as I have found another job. I have a couple of questions please.

1 - I am confused about my holiday entitlement. I have 20 days off a year (jan to dec) then I also have the bank holidays off. I have taken 2 days holiday so far, do the bank holidays form part of my entitlement or not? How do I calculate how many days I should be paid for? Also are they subject to tax etc?

2 - I receive a basic wage plus commission (I am paid 1% of all new business that comes in every month so this is subject to change). Should my redundancy be calculated on the basic wage or should commission be taken into account and if yes how should this be calculated?

Many thanks

Have you got agreement from the company to leave early and still get redundancy.

Holiday should be prorata on 28days. so 4 months worth is 1/3 9.33.

Statutory redundancy is capped at £380 for each years service over that they can pay what they want.
  • To add to 'getmore4less', redundancy is calculated on basic wage usually, but if I were you, I would push for average wages over last 12 weeks.
