I spoke to bus company about cctv and they say only police can request it,

As for the DPA as I believe I am stuck in trying to obtain this cctv evidence. all the help, suggestions and support is appreciated, thanks ppl

Write demanding a copy, clear and to the point to both cctv people stating if your request is not met both will be receiving court papers. Both first class recorded.

It seems to me that unless you have witnesses and/or evidence in the form of CCTV,then you will have no claim.

You may well be left with issuing a small claim to cause as much trouble for her as possible.

There are ..erm...some people who are so used to fraud and lies that it comes naturally to them. Come to think of it,does she even have a driving licence?

you can check..ermm..your own vehicle on here to make sure its insured.

Next thing you know, she will be claiming you rear ended her and caused her whiplash and she will produce witnesses who were passengers in her car to prove it.

However if the road is only thin enough for one vehicle, a simple picture of the junction would show her story to be unbelievable, no one would attempt to squeeze past where there is patently not enough room to do so.
That's the impression I got from this view of the junction:

Unfortunately, as Neilmcl said, the attempt to turn is neither here nor there as she didn't actually complete the alleged illegal manoeuvre. If you manage to get any sense out of the bus driver, all you need is his testimony that you were stationary. He needn't mention seeing the actual bump; only the moments prior.

She could just as easily say that you ran up the back of her..in fact she has all but said it.

Always have a camera in your car and take photos immediately,

On the streetview picture there's something hanging from the lampost next to the Lidl sign - a council cctv camera perhaps?

yes it is cctv cam and I have already been in touch with the council and they say the police ( who will not get involved) can only request the footage. I have however been told I can request under DPA which I am going to do a.s.a.p I also have to make sure thie evidence is not deleted so am going to try to speak to the information commisioner to see if they can help me too.

I am sure I can prove that the angle she was at when trying to turn right would not have allowed me room to pass her without me causing her and me substantial damage, and why would i cause damage to my new car.

All this is going into a very detailed diagram to her insurers, I believe that if I can prove some doubt to her cause of events then her insurer may look in more detail at the dispute.

When zooming in on this, it is pointing the wrong way for the OP.

There appear to be two cameras. One a fixed position pointing in the opposite direction to the junction.

Underneath is what seems to be a black dome camera which can be adjusted remotely to point in any direction.

Information Commissioner is the right way to go, what a shame the council are unwilling to release information to which you are legally entitled.

Update...thx ppl for all your help, after some more advice on DPA I spoke to Information commissioner today for more advice, they clarified my position so I then went back to speak to the cctv people re:camera hanging from lampost, once again they were adamant only police or insurance could apply for footage however I was adamant and the person on the phone went away come back and said yes I apply under subject access however this poses one problem which is if there is any footage I am only allowed to see what it has captured of me and no-one else due to DPA therefore bloke in cctv said it would be all blanked out except for my car!!! I said well thats no use but I then appealed to his better nature and he agreed to go away and check the footage to see if there is any thing that will benefit me on the cctv, I got a call later today to be told the camera was not facing in that direction so that was a dead end.
Not to be put off I got to speak to HR in the bus company and I was given the data controllers details, I rang him quite a lot as he was not answering so I got back to HR and got an email address, one email later and he replied this afternoon stating the same about the cctv and that under subject access it would be blanked out he would not be able to help me.....still not to be put off I rang my insurance company again as I felt they were not doing enough, I spoke to one girl who was not very helpful and kept repeating the same line that they cannot do anything unless I submit a claim or the other party attempts to claim off me this they have not done so yet so they may not be pursuing me for any damages or injuries ( I have been warned that if they have lied about the events then maybe a massive injury claim may be on its way) lol !! anyway I was quite fed up and asked to speak to a supervisor, the bloke I got was a diamond, I went through everything and explained I would not be fighting like this if i was in the wrong, after being on the phone for 40 min's he said that he is going to apply to get the video evidence from the bus and this in no way is going to be a claim on my insurance yippee a bit of good news at last.....anyway I gave him all the bus details and details of data bloke in bus company and he is going to chase him up for the cctv footage. I also have emailed the bloke in the bus company again to ask him if he has heard from my insurers and also I have asked him to preserve the tapes from this actual route on the date and time of the incident but I have had no reply......I am going to take photos and measurements this weekend of the collision site and also measure my car and the same model which hit me, this i am then sending to her insurer next week as well as mine for information purposes only.
Finally I decided to go back to the scene last night and after positioning my car like hers to turn right and because of the junction shape there is about maybe 1-2 feet max road space for me to have tried to squeeze past like she said.....if her insurer looks at this I am hoping it will cast reasonable doubt to her credibility surely??? I await the bus companies response
