Urgent help needed - ebay!

I had a letter some months ago from a company called iQor about a so called debt I owe to eBay for £41.40. In addition to this letter, then kept phoning my house and I told them to not call me again and that I was disputing this debt as I've never had an ebay account.

They told me I needed to get a crime reference number for identity theft which I laughed at and thought nothing more of it.

Today, I have received a letter from Geoffrey Parker Bourne solicitors saying that if I don't pay within 7 days of the 'above date' which is 21st April (so I basically have TODAY to pay), a County Court Claim will be issued without further warning and with costs, I will have to pay £106.40.

Can anyone please offer any advice on how to deal with this?

    Report it like they said give them the crime reference number maybe this will deter them from taking action whilst you resolve it with the police? I dont know but sounds a bit scary! Did they use your name or your just address on ebay?

    According to iQor, they've got my name, address, date of birth and home phone number but there's no knowing how much of this they 'obtained' from other sources.

    Why didn't you report it when you found out?

    I think you also need to check your credit report to make sure it's just an ebay account they opened, and that they haven't built up loads of credit card debt or loans.
    Unless I say otherwise 'you' means the general you not you specifically.

    My credit history is rubbish anyway and I received my credit report a couple of months ago when applying for a new rental house.

    I didn't report it because the lady from iQor, when telling me to report it, said herself that the police probably wouldn't be interested but to report it anyway, so why report it when they're not gonna listen?

    Additionally, I've since learnt that you don't need any proof of ID to open an ebay account.

    I recently opened one to sell with. No I.D. needed etc BUT they did call me (automated) on the number I gave them ( I was a bit surprised about that ) but maybe the phone call is a new thing.

    If someone has committed identify theft, as far as the company is considered you owe the money as they have your details and they match up, if you don't do anything what do you expect will happen. You must report it to the police otherwise they may consider you are just lying. Even if the police do not investigate it is a matter that has to be dealt this way as fraud is a criminal offence.

    CCJ costs are £75, so i would expect your bill to be £116.40 not £106.40.
    If it goes to court and you pled it as identity fraud, the judge will ask you did you report it to the police, the answer of no is not the reply he will be expecting...

    I also agree, get all 3 credit reports £2 each postal orders, and check that other people have not taken out credit in your name. I also recommend you get the CIFAS flag put on your file.

    Request that they supply you evidence of this debt, Then you can see what is going on if they supply it. If they do take you to court you can request that it is local you can then go and dispute the debt

    Speak to someone from CAB they will be able to give better advice
