Ending periodic tenancy - which date do I have to vacate the property?

Apologies in advance if this is a silly question but thought I should check as it has some implications for us moving to our new property.

We are about to give notice on our rented property. We are currently on a statutory periodic tenancy running from the 1st to the last day of each month and we pay our rent on the 1st of each month.

1) If we give our month's notice today (or anytime up until the end of April) would we have to vacate the property on the 31st May (Bank holiday) or the 1st June? We do not wish to be liable for another month's rent. Ideally we wish to vacate at the end of the day on the 1st June

Am I correct in thinking that as long as we vacate the property by the end of the day on 1st June we will not be liable for a further month's rent or would this only be the case if we vacate on the 31st May?

2) Also, we rent the property through a management/letting agency and have never had direct contact with the landlord. Is it sufficient to give them notice or do we have to send a letter to the landlord also? Can we email the agent or do we need to send them a formal letter of notice?

    1) 31st May (End of 1st June would legally mean another months rent but ask your LL as they may be able to be flexible)
    2) Send the notice (on paper and through royal mail - you could use recorded delivery if you want but unless you believe there will be a dispute it is not necessary) to the address given on the tenancy agreement which may well be C/O the agents.

    If you vacate the property on the first day of the rental period (1st of June) then you will be liable for the whole of the month's rent. You need to give notice before the end of April and vacate on the last day (the 31st) of May. Give your notice in writing, sent by Recorded Delivery to ensure it is received on or before Friday

  • you could always ask for the one extra day and to pay 1/30 of your monthly rent for the benefit of it- they may say yes with adequate notice- just make sure to get it in writing
