HSBC claim (DMP)

Hi all, just a couple of quick questions, hopefully somebody can help me out. I submitted several years ago a claim against HSBC for bank charges but it was on hold for the test case. My partner and I where then in financial hardship last year, they asked for SOA which I sent off and they said we wasn't in financial hardship but they did refund me £250 as a gesture of goodwill (only another £1500 to go lol). I have just re-read the bank charges guide that Martin has updated and it states that if your are in a DMP etc you are in financial hardship. We entered into a DMP last autumn with payplan after I got the £250 back. Does this now mean that because we are now in a DMP that I have a good chance of getting my charges back as HSBC are one of my creditors I owe (overdraft). My payment to the HSBC overdraft isn't enough as they keep charging me every month so the debt is growing!!! Do you think that if I just ask for the overdraft to be wiped out, rather than the much larger amount of charges to be given back will they do this? Has anybody else been in this situation?

I hope he said that you could be in financial hardship rather than are. Furthermore, the £250.00 can be seen that HSBC have complied with their obligations under Financial Hardship. They do not have to refund any charges under financial hardship so at the moment am not sure where you are going with this.

If you are in a DMP have HSBC stopped making bank charges and are simply charging you interest on the overdraft?0 -

Yes that right, since being in the DMP they have only charged me interest. But since reading the reclaiming guide, I was hoping to reclaim the couple of grand that has been charged over the last few years, if not the £1400 overdraft I had with them so that it's not on the DMP, if that makes any sense.0 -

If you read the bit in read then I think it is unlikely that they will make any further offer0
