car deposit

ive paid £250 to a dealer to get a car from another dealership in the group. and i have signed a sales order form

i was told that if the car was not right, then i could have my deposit back.

the car is not right, its a mess, i allowed them a week to put it right, but all they did was wash it! they are now being difficult with my refund.

this is not 'ive changed my mind', this is 'the car is not as described'

should i be entitled i get a full refund?

    What does it say on the Sales Order Form about return of deposit ?

    When you say "not right" what does that mean ...not the right model, different year, different colour ....? If the car they have got is what you asked for, and you just don't like it now you have seen it you may have a problem getting all the deposit back..

    They will probably claim they have incurred costs by getting the car from another dealership, whether you get the deposit back will depend on your answers to the above questions.

    sorry, 'right' as in the car was not fit for sale imo, scratches all over, dent on boot, illegal tyres, hole in the seat. this car is only 2 years old.

    they fixed the some of the scratches (by polishing) and knocked the dent out after 1st inspection. but the tyres are still illegal and seat is still ripped.

    the car is still not tidy as i would expect from a dealership.

    i'd give them a 2nd the chance to fix the problems but ive been fed nothing but lies and general bad service which has put a sour taste to the deal.

    i dont have the order form with me to check unfortunatly.

    if its evans halshaw then even if the car has scratches - as long as it starts and is road worthy you'd have to buy it or not get deposit back.

    its a quick money making scheme - bit of a con really - i bet most people just end up buying the cars!

    they tried to do it to me! tried to charge me £250 for transporting a car 10 mile down the road... i was like no thanks i'll just drive 10 mile away from your smarmy face to see it!

    ive got the t&c's here now.

    does a bald tyre qualify for this? even though it could be changed if i give them ANOTHER chance.

    the thing is, if i sent the wife to collect the car, they would have let her drive away with it.

    I would get your camera out and take photos and when they ask why you can just say that your gathering proof should you need to go via small claims

    depending on the circumstances... lol! do you not think they have every corner covered?

    i was told by a very miserable EH SA that you can't get the deposit back if its cosmetic problems! only problems with engines etc!

    Since when do Evans Halshaw make law?

    The 'circumstances' depend on whether the forfeiture of the deposit would constitute a penalty in respect of not proceeding with the contract of purchase.
