sorry, no legal help at all. But surely if he is entitled to 1/2 the property then they woudl both be responsible for essential repairs that needed to be carried out on the home? Maybe check with your solicitor? Surely if he refuses and you have it in writting that the repairs were essential and would knock 15k off the sale price if your mother paid for these repairs then she should benefit from her investment in the home? Its not like she is asking for anything that is unfair IMO
Ring your/her solicitor this morning to check, a quick call should get you the legal answers you need.0 -
You dad isn't even living there so surely it's your mother that has neglected the house.
She could've got the insurance herself ya know. She is a grown up!0 -

This is not a helpful comment at all! So what, her mum pays for all the repairs, insurance, etc and he sits back, pays nothing and then gets 50% equity when the house is sold? Yeah that's fair!
OP, If your mum doesn't get the money back from her ex, make sure she keeps the recipts and letters from the builders about the repairs as this will then be deducted from his share in the house so she will get slightly more equity in the end. What's yours is mine and what's mine is mine..0 -

Of course it's fair.
She expects him to pay for 50% of an upkeep to a house he doesn't even live in.
If it's that much of a problem, then sell it now, split the cash and all is well.0
