Thats aviva for you. (Though they have no particular reason to chase up their client on your behalf!)

If you look em up here or anywhere on the net, you'll see how apalling their service is, yet they carry on playing the numbers game. (Only people who need any service from them realise how bad they are, the rest just are happy to be paying what they think is a good price for their insurance)

Quentin - you now have me confused again on how to handle this claim. Who should I be chasing if it isn't Aviva? Are you saying I should be chasing and sending notice of legal pursuit to the insured directly instead?

They are not chasing their client. They have only just written to him to ask about the incident. I thought by contacting Aviava I was initiating a claim and they would have a responsibility to contact their client.

Didn't intend to confuse - just agreeing with your "shower" comment! If they treat their own customers so badly, you can't really expect too much from them when you are "just" an injured third party!

Carry on pursuing them, if you get to legal action you at least know they are likely to be able to pay!
