what are my rights?

bought 2 sets of glasses from specsavers 1 of them was prescription sunglasses. i needed these for my holiday however when i phoned up to find out what was going on they told me the mixed up the lenses for the frames i chose for the sunglasses with the ordinary glasses. they ordered new lenses so on my return they would put them in the correct frames. so i took the sunglasses on holiday however i found i could not wear these as the tint was too light to wear in the sun.
so on my return i phoned them and told specsavers that these where not acceptable. they told me i was shown how light the tint was in the shop when i placed my order, but how would i know if they are right in the sun? they did however offer to order the darker lenses, say if i am still not happy?

what are my rights could i get a refund?

thanks in advance

It would have to be a judgement call on if you would have been able to adequetly judge the amount of tint without actually going on holiday. Personally I would side with specsavers on this one that it should have been possible for you to do it and it just sounds like you are now trying to have just had free use of the glasses whilst on holiday.

They should have shown you some sample lenses with the different colour tints - grey, brown or green. Once you pick your colour, they should explain it comes in 3 shades, and show you examples of these. Did they do that?

As long as you accepted the tint chosen, they didn't have to show you any variation.

I've had bad experiences with Specsavers, I found them to be very pushy and much more concerned about making a sale than actually meeting your needs. However I'm afraid I do think they are in the right this time, you did choose the lenses. I would accept the darker lenses they have offered, as they are not obliged to even offer this.

No help to you now I know, but in future I would stick to a local optician and go by the recommendation of others. A local optician may be more expensive, but it's well worth it for the difference in the level of service.
    Gone ... or have I?

This happened to me the first time I went to specsavers but the assistant offered to have them darkened without me asking (or having to pay any extra). I now always order the darkest tint .. the only problem is that I wear a dark suit I look like a flamin gangster :D:D
