I've got an unused cosmetic kit here which needs to go back. I emailed the company last Aug to get them to pick it up, as I wasn't going to use it. No response. I've had a letter now from a credit company demanding the money plus court charges etc. I've spoken to the company, they say they sent me a letter, but I never received it. I've still got the kit here, can they take me to court for non payment even if the kit is sent back at my expense? Any help much appreciated. Thanx
I get paid to smell great :j

If you emailed the company within 7 working days after receiving the kit then they should have refunded you under the distance selling regulations (assuming this was mail/internet/phone order). Do you still have a copy of the email you sent and was it sent within those 7 working days?
There is a possibility, of course, that the company may not have received your email - did you follow this up at the time?0 -
Unfortunately I've not got the email, computer glitches etc. The kit was sent foc to start with , then I had to do so much in sales by the end of June, which they then changed their minds and said Sept. I knew I wasnt going to do this, which is why I asked them to pick up the kit. Once you did the said amount of sales you then got to keep the kit.I get paid to smell great :j0

Sorry - I assumed that you'd purchased a make-up kit and then changed your mind about it, I didn't realise it was linked to sales. Did you sign any sort of contract or do you have any terms of sale to refer to (check to see if there is anything there about sending the kit back?)0

Check the T&C's carefully. I think that you should just renew your offer for them to collect it. As it was payment in advance for you fulfilling a sales contract, the proper recompense is for them to accept the kit back.Unfortunately I've not got the email, computer glitches etc. The kit was sent foc to start with , then I had to do so much in sales by the end of June, which they then changed their minds and said Sept.
