DVLA fine for not having road tax

Hi, sorry for the lengthy post but here goes.

In November my wife had a wee accident and as a result our car was written off. Fast forward to today and we received a fine for not paying our road tax. In between, we had to buy a new car and transfer my private plate (an unwanted gift may I add) from the written off to the new car.

This all got done eventually and I received two new V5 documents, one for the new car and one for the written off car. The insurance company wanted the one for the written off car so they could get it written off, in the meantime I sent off the wee slip of paper to the DVLA saying I was no longer the registered keeper etc etc.

Now I never received a letter from the DVLA confirming they had received this slip, however, when I called them today they confirmed a letter was sent out to me. Here's another however, the lady who told me that said she cant cancel the fine, I have to write in and state my case. All well and good but I have no V5 for the written off car, and no letter from the DVLA saying it has been written off.

I'm off to scour the house for the letter from the insurance company to say it was written off but is there anything else I can do to not pay this fine? Thanks for reading!

    If DVLA have said that you were removed as keeper on the correct date (and this wasn't backdated e.g. you sold in Jan but only wrote in in March) then a simple letter stating the full details should suffice.

    It all depends on what the record shows. Occasionally with plate transfers the 2 records can become a bit distorted due to the change of plate.

    Write in saying you sold x car (make/model) with x plate (replacement number plate issued after plate transfer) on x date to x person/insurance co, and that previously the vehicle displayed x plate (private one).

    DVLA will then check the records for both plates and hopefully it will be resolved positively for you.

    Just write them a letter stating your case for now. They tried the same with me years ago over a motorbike I scrapped for parts. Just explained that I'd sold it off, and that seemed to satisfy them. Worth a try at least.

  • Thanks, I'll do just write in stating my case. I also phoned direct line who confirm they took ownership of the car in November, they're sending me a letter stating this too so I should be fine. Just as well as I can't find any documentation, what a filing system I have!
  • i buy in and break toyota 4x4's and last week i had a letter from DVLA stating i never taxed a 4x4 at the begining of february.I rang them up and stated the vehicle was scrapped on the 23/01/10 and they said they were not notified by me that it was scrapped.I told them that as i never had a log book and that i wrote a letter and stated the vehicle details and put in a copy of the tax reminder.I was then told they haven't recieved it and that i am still liable for the fine.
    I will be writting back to them this week and state i am willing for them to take me to court over it as i always make sure the vehicles are reported as scrapped as soon as i start to take parts off.
    There have been numerous reports on watchdog and court cases stating that the DVLA are known for losing mail and they send fines out due to their own incompetence
