Car a write off ?

Hello all,
Last July 2009 My car was hit whilst parked.The driver did not stop and was never caught. It was classed as a cat c write off as the value of the car was less than then the damage caused . I accepted payment from my insurance company and bought the car back from them.
I was at the end of my policy with them so looked around for a new cheaper one.
Company I am with now did ask if I had had any accidents etc to which I replied yes , I did not lie about anything but the question was never asked if it was written off.
I insured the car,re-taxed it with no problems and will MOT it in June when its due.
My question is,is that I recently did an hpi check and the veh came back as a write off but on checking the VIC database it is not registered as a write off there.
So insurance company wrote it off and DVLA were never informed as I spoke to them.
I'm confused,is the car legaly on the road or not ?
Surely my insurance co would have that information ?

I would imagine Cat C would be classed as pertinent information if you weren't asked directly, and weren't asked if the car had, to your knowledge, suffered damage. I'm pretty sure that if your current insurers don't know about this then you're not insured, regardless of how that situation came about.0

It can depend on what category the vehicle was written off under. A VIC marker is only used for Category C write off's. If it was a Cat D then this would not show on DVLA/VOSA's records as needing a VIC. A Cat D can show on insurance company databases though.

OP... I might be being dim but i don't see what your problem is?
Cat C & D cars can be legally used on the road as long as they have valid tax & MOT (both of which can date from before the accident), are insured and roadworthy. Basically the same rules that apply to any car.
Cat C cars (which have the VIC marker set at DVLC) can’t be re-taxed or issued with a new V5 until it has had the VIC done.
If yours doesn’t have the VIC marker set then I guess your insurance company made it a Cat D.
Either way, nothing to worry about, just keep using it.0 -
Thanks. Hpi check revealed it as a cat c but dvla and Vic check don't have it registered. I have taxed it since the accident on line with no problems.0

Nothing to add IMO, thousands of cars are sold to be repaired every week and do indeed get repaired and used again. The insurance companies actually sell them so it can't be a problem to insure and use it.
Only fly in the ointment of course is if you are unfrtunate enough to have to claim against the car again, its value will obviously be less than what it was before to reflect its cat D/C status.0
