They also remind you that creditors by law have to accept your offer, so long as it's over £1.00 per month.

is this true? i have been on dmp for about 6 months and hsbc have always refused my £30 a month against my £1500 overdraft and are now in the process of selling my debt to a another company. i haver only ever missed one payment?

No it is not true - far from it. See here: #8

Read the whole thread, don't just pick up the bits you want to see ;)

As for HSBC you need to be speaking to them a little more stringently, if you still have an o/d facility then they do not have to accept anything, you just reduce it by whatever you want to each month.

If they have revoked the o/d then best to speak to them and explain the £30 is a starting point and will increase. Depends on your situation, or if you dispute the content of the o/d (i.e. lots of charges) then they cannot do much anyway.

Try being specific if you want specific help :p

    Hi,

I have a letter from Hamptons Legal regarding a debt of £7.00. They are threatening Bailiffs and a possible charging order. I have called my local Court and asked what the minimum amount of debt that could be taken to court. They have said that there is no minimum but whether the company would want to pay the court £30.00 to take the balance through the court. Do you really think that this will make it to court?
    thanks

You ought to be ringing and paying the £7 - regardless of whether you think you should or not, its £7 !!!!!!!

Just pay it...... will make your life a whole bunch easier... :o

Thank you for your comment, I don't owe it so why should I pay it. My original question was, do you really think they would go that far for £7.00?

No they will not go that far, if you do not owe it then ring and explain to them. BUT i'm saying, for the sake of £7 you have to forget principles cos it can still leave you a default which is absurd - just pay it and move on. It'll cost you more in the long run, arguing it!

Or report them to the FOS - let them deal with it.......
