Quick question regarding benefits

Hi,

My fiancee has her own flat and has had to claim housing benefit and council tax as her hours have been reduced from 40 to just 8-12. I believe she is also having to go on JobSeekers as she now earns less than the recommended minimum amount to live.

My question is, I earn quite a lot more than her, and occasionally stay at her flat, but don't contribute towards the household. What are the maximum number of nights I am allowed to stay without it affecting her benefits? Or raising any eyebrows about potential fraud etc. Last thing I would want would be to cause her any trouble. Hopefully her contract will be amedned shortly up to a minimum of 28 hours. However her boss is dragging his feet.

If anyone could provide a definate answer and possibly a source. I'd really appreciate it

    Hi tried to find an answer but didn't have much luck with direct gov.

    Obviously you'll know what council area you are in. If you go to their website and look under housing benefit it might say, although I looked at my councils and it didn't give any specific details. It just said if someone has moved in or out, not what amount of time spent sleeping over counts as moving in. Sorry I couldn't help more. :)

    technically actually staying over makes little difference. if your spending 'time' there it could be classed as 'being there'
  • their is NO definitive answer,it depends on many factors,and there are alot of threads on here that cover this subject
