HMV - returning a faulty item - rights!

Hi all!

Basically, last July I bought my husband an iPod Touch (8GB, 2nd Gen) for his birthday.
Come now, and the iPod has a fault - the on/off button is temperamental and doesn't work properly - this means often we can't turn off the iPod. Not a huge fault admittedly, but it still shouldn't be happening. (iPod has never been dropped etc).

I want to return it to HMV - as it is only 9/10months old, it is still within it's 1yr manufacturers guarantee. My question is - will HMV offer a refund, an exchange or store credit?
We are reluctant to get another, and would prefer a refund, but am not sure if we are entitled to this or not.

Can anyone advise? Has anyone had a similar experience?

    Its likely to be a repair given the age.

    The chances of a full refund are pretty slim I would say, they will more than likely offer you a repair and they're within their rights to do this. If by chance they did agree to a refund they don't have to give you the full amount that you paid as you've had 9/10 months use out of it.

    I had practically the same problem as you have about a month ago, I'd bought it in September last year and it was faulty, took it back to HMV and they replaced it, I think your chances of getting a refund are quite slim as it's past their 21 day returns policy, but it's worth a try. They may also ask for the accessories that came with it, such as the USB lead and the headphones

    Ahhh thats fine - the headphones were never used in the first place (had more expensive ones) and the USB cable is still there.

    A replacement would be fine - I just didn't know where I stood on it all!

    Sorry to butt in but while HMV may have a 21 day return policy they do not give refunds at all unless the item is faulty. For a duplicate gift etc it's exchange or nothing :(.

    I agree, and would highly recommend a Sony MP3 as an alternative!
