    I am not so sure about the lying bit - many of the witnesses lied and contradicted each other at the Tribunal and some were challenged by the Judge and it was also obvious that they had manufactured evidence but the Judge managed to skirt around it - it was not pertinent to his decision that I was sacked for breach of trust and confidence. In effect I was, as the employer saw it as a breach of trust and confidence that I was challenging the correctness/legality of their actions.

    I think the point here is that many people will get a settlement if they continue to pursue the case through the stages of the ET. It is not unusual for settlements to be reached on the first day of a Tribunal and they can be reached at any stage during a Tribunal too. If you are representing yourself it sort of reduces the opportunity for this to happen beforehand. I think either side can ask ACAS to approach the other for settlement discussions. Every case is referred to ACAS who should make contact with you once your case has been accepted, to discuss a way forward.
