Subletting Advice

Hi all,

Hope someone can advise on this.

I lived in a property for a couple of years and am moving out. My brother lost his job so lodged with my girlfriend and myself (for about a year).

My girlfriend and I are now moving and my brother wants to stay and pay for the house himself. If i tell the landlord I am moving out they will probably not allow my brother to stay. I am thinking of keeping the house under our name so they he can stay - so the rent will still come out of my account and my brother will pay me.

Please can someone offer any advice - as I dont want to have to tell my brother to find somewhere to live but also dont know if i can keep the house in my name.

    I think this is a breach of your tenency agreement and will get you 2 months notice, have u got an assured shorthold tenency? why would they throw your brother out? maybe you could stand garantor for him or still pay his rent to them and him pay you if you are worried they will think he is not financialy secure but I think honesty would be the best policy, remember good tenants are not easy to find and it costs money to advertise, check refs ect, shelter will be able to give you the correct legal advise if you ring threm

  • I thought it would be a breach but read on the web only some may not allow it. We lived there for 3 years but for the last 2 years have just had a rolling monthly contract. I wouldnt be throwing him out but if they didnt let him stay he would have to find somewhere else to live - therefore not having a home for a while.

    I agree honesty is definately the best policy am just worried that if I propose this they will just say no and he'll have to move on - (the estate agents the tenancy is with arent the nicest people)

    i'd just leave him in the house, ok your probably breaching the agreement but if they do cancel the contract then you wont be homeless and your brother will be in no worse a position if you told them
