Well I suppose it depends on how you want to play it.
If you're happy to negotiate with them then do that.
Otherwise sit tight and wait for them to send you a TN.
If they terminate your account on the back of a dodgy DN then all they can ask for is the arrears stated on the DN and nothing more.

Negotiation is out of the question now. They have clearly demonstrated over the last 12 months that they con not communicate on any level at all. As for paying the arrears, I woun't be paying that either.
I should not have had these arrears to start with. The letter I have from Welcome on the 18th December, which they quite conveniently can not find anymore, clearly states that they would terminate the agreement, use my extra payments I had made since April when I requested to VT my agreement, to clear the liability they claimed I owed, and close the account.0 -
Just as long as you keep hold of your copy, it's not like you're going to go to the trouble of copying their letter headed paper to fabricate your own is it?
Are you happy to put up with the car on your driveway?
Also if you're unemployed atm you wouldn't want to be taking on any more credit surely?
What about charging them a storage fee based on a daily figure?
They are so desperate to get as much money out of people as they can because they are in the biggest hole you could ever imagine.
If it were me I'd want this to go to court to get finalisation.

To right I've got the paperwork kittiej. I actually have the originals they sent me, not copies.
I have thought about charging them a storage fee in the past, but didn't know if that was legal to do, but at this point, they're taking the !!!! out of me, so I may as well return the favour.
I'd like it to go to court, but don't know whether I should be taking them to court first, or wait for them to take me. I haven't spoken to anyone at the CAB yet. Would that be any use at this point in time, or am I better served getting proper legal advice?0 -
Well chris if it were me, I'd wait until they take it to court and you can defend and counter claim with storage fees-but that's just me. I'd be thinking let them do the leg work to get it to court esp if you don't have the available money to take it to court with not working.
It certainly couldn't do any harm to go to CAB, they do have solicitors who give some time to them.
Just a thought, but it might also be a good idea to get a valuation on the car because if it sits there for another 2 years it'll only be good for scrap and you can then show what the car could have fetched had they just taken the car back like you asked.

I've never thought of getting a valuation. Your right it would be good to show them the difference between then and now.
It has certainly been a very trying 12 months, and this last week has just heaped more pressure on an already hellish situation.0 -
over a week now, and still no call back as promised. Can't say I'm surprised to honest.
I have scanned the documents they sent me for the official default notice.
As someone mentioned before about the dates. The default notice doesn't give a specific date. there is a date of notice at the top of the letter, then it says I have 14 days to pay the arrears. But it doesn't give a specific date.0 -
