Disability premium

This is a question on behalf of my Mother. She has received DLA for many years but has just found out that as she lives alone she will be entitled to a disability premium. How far back will they backdate this for her?

    It depends - is she already in receipt of Income Support? How much does she receive (IB and IS), and what rate of DLA is she on?

    Disability Premium is only payable if someone is receiving means a tested benefit e.g. Income Support, Income-based JSA. What other benefits is she receiving?

    She is in receipt of income support and gets the middle rate of DLA. She is been told that she should be getting about £52.00 a week. She was just wondering how far they will backdate it?

    If she was not currently receiving IS, the backdating could only be for a maximum of three months. However, as she already receives IS I am not aware that there is a limit as to the backdating of premiums. Did she inform IS when she received her DLA award?

    Yes, income support know she gets DLA, she has received both for many years. I think she recieves about 180 per fortnight in IB & IS. She has carers that come in a few times a day. I wasn't sure whether there was a limit to backdating premiums, I was aware that they backdate many ones for three months.

    Does anyone claim Carers Allowance for her?

    £90 does sound too low for a long term claimant. Does she have savings above £6,000?

    There was a thread recently about the backdating of premiums, and from what I remember there was a case that found there was not a limit. I'll have a look when I get home.

    I cannot find the case I was thinking of, but as long as you can prove you notified the DWP of the DLA award, there should not be a problem in long term backdating as it would be classed as an official error.
