Missing Item from Bundle? (Expansys)

Hi there,

I've recently bought a Car Dock Bundle from Expansys which as the page on the website describes:
"A great value-for-money car pack, including the flexible mounting car holder and in-car charger for your HTC Desire."

The picture alongside it also clearly shows the items included in the bundle.

...however I've received the item today (money has been taken out of my account) and it only includes 3 out of the 4 pictured items (Suction Mount, Swivel Mount and PDA Holder - no Car Charger).

I'm a bit worried because there is another item listed on the website which looks identical but is £7 more.

I've contacted Expansys to let them know that the car charger is missing - but what happens if they come back and say that I've purchased the lesser version (even if the product picture and description clearly indicates that the car charger is supposed to come as part of the bundle). What are my rights on this?

    If it's not as described then I'd say you have grounds for taking this up with them. I guess the outcome depends on where the error occured.

    Do I have the right to tell them that they have to supply the missing item from the bundle or is the only right I get - a refund.

    Firstly, save an image of the webpage before they 'correct' it.

    Your untimate resolution is to send the stuff that you have got back for a refund under DSR. You may not get return postage repaid unless they agree its faulty... depends on their t&cs.

    They could offer to supply the missing part. You have to negotiate for the solution you want.

    You are right to want what you have paid for, but I would advise against getting to worked up about this or spending too much effort.
    After all a USB car charger is only a few pounds.

    Hiya,

    Firstly as you suggested I've took a print screen of the page and saved it for future use. I rang them up this morning and explained that I had only received 3 out of the 4 items, and they said that 'apparently' that's all that I should be getting, but once I told her that the product page clearly states that the car charger came with the bundle she put me on hold and that said that she'd email the product manager who should send one out me over the next couple of days....

    I don't perticularly trust her however!

    I guess the next question is - can I claim back postage?! Because I paid for next day delivery on my item, and seeing as though only 3 of the 4 items were sent to me I've paid a premium for next day delivery for little point.

    Why didn't you ask the nice lady when you spoke to her?

    Yes of course you can claim back the extra postage. These days you can claim for anything you like.

    If I was Expansys, I would reduce that claim by 75% because three out of four items did arrive next day (did they?).

    'Loss of enjoyment' may be something else you might like to claim for. ;)

    Why didn't I ask her? Because quite honestly I didn't stop and think about it till I was off the phone plus I wasn't aware of my rights (hence me coming on here to ask you nice people).

    I'll wait till Thursday and see if anything arrives if not I'll give them another ring and I'll bridge the discussion of postage compensation with them.
