She says there that she is not really concerned whether she or the Receiver gets any money from her former employer, the principle is more important.

I am well aware that IN LAW bankrupts dont have to repay money they owe basically - and that it would appear that "the slate is wiped clean". In moral terms though - they DO still owe this money and the moral obligation to repay it is there/will always be there until such time as it is repaid.
O.P. sounds like she was put in this situation due to no fault of her own - which I know can happen to people. O.P. also sounds like she intends to go ahead with this (even if its her creditors - rather than herself) that get the money. Well - all I can say is = highly commendable of her:T
Most bankrupt people would say "I dont owe that money any more" - just because that is the legal position. It sounds like O.P. is ignoring that "get out clause" and accepting that she still does in actual fact and intends to repay it - well b****y good for her and I hope she succeeds in this.0 -
I would recommend reading a some of the OP other posts/threads, there is a lot more to this situation that the post here covers.
Some of those threads may be a better place for the direction this thread is going.

I was made redundant 19/11/09. I am aware that I may not be able to keep the money. But, I am an emotionally strong person, I came through my BR pretty unscathed so I am ready for a tribunal, but thanks for your concern.
I really believe this company treats it's staff diabolically and if I can get justice for what they did to me, then maybe it may make them think twice about doing it again. Without going into the details, it was personal they wanted rid of me because I was vocal.
If you have read my other post, then you will appreciate I don't like employers being able to get away with treating their employees badly.

I have been in touch with my union rep. He is going to find out if I have a case and I will get legal aid from my union, so I will give it a go. He thought their might be and that we had up to 13th May to try.
I don't need a reference as such from them now. I know three employees that I worked closely with would give me a reference and as I am volunteering now, I can always get a reference from them too.
P.s Jimmo, you are incorrect in what you assume happens to a Bankrupt. While undischarged anything that we earn over our necessary living expenses is paid into a payment agreement, so earnings of over £500.00 pm the OR takes 70% for up to three years. The OR takes assets from you which have a resale value of + £1000.00, such as a car etc. The house is usually taken if it's got equity, you can keep the house if it's in negative equity depending on how much your monthly payments are if they are deemed to be too much then you have to move out, if the NE is only small they can put a charge on your property to make you sell it, for up to five years after the BR, to realise the equity. I am not bitter about loosing my job, I have moved on my life is much more positive now and I am doing some really fulfilling things now volunteering etc. But I am a socialist.
With the help of the union I think I will be alright.0 -
Oh yeah forgot to mention, the company isn't in any better state. They have had to employ someone because they never realised how much work I did and now they have a massive backlog. :rotfl:0

That will be too late for the ET, they have a 3 month time limts.
There are some exemptions but I don't think your case would qualify.
If they are stuck the best option would be to offer your services perhaps on a contract basis but from the other posts would you actualy want to work there again?
