Need help sharpish on this one...

Asking on my Sister's behalf.

She's been renting with this guy for about 14 months paying half the rent. The guy she was renting with was already in the property prior to her moving in and was looking for someone to share with due to the cost.

anyhow the guy has emailed my sis this afternoon saying he is now leaving, but has spoke to the landlord who is fine with my sister taking on the property as long as she signs Tenancy Agreement. He goes on to say that if she can't get someone to flat share with her, her sub let agreement ends when he leaves at the end of this month:eek:

She is now well and truely up sh*t creek I think and I have asked her if she remembered signing anything and paying a deposit. She said she paid upfront but doesn't remember signing any agreement!!!

So basically i'm not to optamistic about her options, I'm I right to then think that she will have to leave next Friday????

any help will be much apreciated, thanks peeps

    Did she pay the other tenant her share of the rent directly? This would make her his lodger (exclusive occupier) or subtenant with possibly quite few rights whereas if she paid the landlord directly, she would be his tenant.

    What is the rental period - did she pay monthly?

    i'm 99% sure she just bank transfered her half every month to the other tenant ( can't believe she's been so stupid :mad: )!!!

    not sure about the rental period, the other guys been staying at his new lady friends so has hardly been there for last month or so. I don't think the tenancy is up he's mates with the landlord, just think its his decision to leave!

    looks like i'll have to tell her the grim news

    Sounds to me like she's homeless as of next Friday, and will hopefully never be so short-sighted again?

    Contact Shelter - sounds like as she's not a tenant, she has limited rights. Could she negotiate extra time with the landlord to find onward accommodation since it seems she's not prepared to take on the tenancy in her sole name?

    However, by accepting rent directly from her, if he's wise about the legal position, the landlord will know that he'll be inadvertently granting her a tenancy even if she doesn't sign the new AST simply by accepting the payment of rent, therefore he may actually prefer that she leaves.

    Get her to phone Shelter for free expert advice.
