My rights after buying a car

I purchased a second hand car from a car dealer about 2 weeks ago.
I Paid £1450 for it and on there was never any mention of a warranty (equally there was no mention of it not having a warranty)
On Saturday (after 11 days) the engine manage light came on. I disconnected the battery and it disappeared. Today it is back again.
The car was not sold with any known faults and it wasn't spares or repairs or sold as seen.
Do I have any rights in this situation? Should the dealer pay for the repair?

I spoke to the dealer and he didn't seem too keen.
When we purchased the car it seemed odd that the clock reset buttons looked worn. I think I have set the clock in other cars only when daylight savings time changes. It looks like it might have been a preixisting problems - Which from the link looks good.
I agreed I would pay for the diagnostics then we would discuss the repair.
Also mentioned that the alloy wheels he fitted rubbed on the wheel arches - He was more keen to sort this problem out for me - Presumable because its only the cost of some spacers.
I'll keep all receipts and ask for compensation by post.
Can I threaten to pursue it in a small claims court if he doesn't agree to pay? What are my chances of success?0 -
If the wheels rub on the arches the vehicle is not fit to be on the road. I'd say you've got a very good chance of getting your money back in full.0

Here is a short version of a very long story concerning buyers rights. In May 2009 I purchased a used car from JTR Cars in Croydon. Within 24 hours I found that the central locking was faulty, the exhaust had been botched up and there were around 12 descriptions in the advert that were false. I did some further digging and found that the mileage had been clocked back from 100K to 41K. I contacted the seller within 2 days of the purchase who told me that it was hard luck because the car was 'SOLD AS SEEN' . Since then I have been through consumer direct, trading standards and the county court who ALL say that the trader has acted illegally and owes me my money back. The county court issued a summons which the trader ignored and I was advised to instruct a bailiff which I did. The bailiff got nowhere. I still have the car which has not been used since the purchase and I have a shed load of legal paperwork saying that he owes me a full refund and has broken several laws. the bottom line is that there is nothing I can do about it. The best part is that JTR Cars are still trading and still stitching people up, I know this because the bailiff say that they have several warrants of execution against them. SO MUCH FOR BUYERS RIGHTS..0

I've seen a disclaimer in many adverts saying 'No warranty given or implied'. It seems this is your dealers standpoint as well but he didn't actually state this. You may have rights but to be honest I doubt you'll get anywhere trying to get any money back from this Del Boy. it'll cost you time and stress in pursuing it and he could argue that he gave no warranty and that the engine light came on after he sold it so nothing he could have done about it.0

Might be true of new goods where it's black and white what should and shouldn't work but a second hand car is a huge grey area. Why do you think so many places offer independent checks? It's like buying a house which isn't new. Buyer beware.
At the end of the day this car was under £1500. The chances are that any car of that price/age is going to have something wrong with it. Granted the wheels shouldnt rub, but an engine light coming on 11 days after purchase? Why is that the sellers responsibility?0 -
This was my first though. However I have since spoken to the service manager at Hyundai and he was confident that I shouldn't pay even for the diagnostics and I should return the car to the dealer.0

I don’t know if it is the sellers responsibility but the law is clear, any significant faults that appear in the first six months are the dealers problem unless he can prove the fault didn’t exist when the car was sold.
The grey area is what is significant on a £1500 car which is hard to comment on until the fault is diagnosed.
Whatever the fault the dealer is going to struggle to prove the fault wasn’t pre-existing given the evidence about excessive wear to the clock setting buttons which tends to indicate the fault is long standing and therefore either expensive to fix or hard (and therefore expensive) to find.0
