hi, what are you claiming the 3 x for? if it is for not registering your deposit be very careful. we went to court on the same thing, first judge told us we would be awarded 3 x the deposit, we went back in for final hearing the other solicitor provided a skeleton bill which states that if the landlord has not registered your deposit within the 14 days of you moving in, then they have 14 days from the point you take the to court to register it, which means you will get na da.STARTING BALANCE JAN 09 £47,400
Debt left 24th December 2010 - 13611!!!!!:j
Update may 2013 - debt left £8000
Update oct 2014 - £25000 -
why is your landlord refusing to return your deposit ?
when did you last sign a tenancy agreement ?0 -
Reply: cakey:the reason claiming the 3X,because the landlord didn't put our deposit to "Tenancy Deposit Scheme"
In our "Tenancy agreement" the landlord promise will put our deposit to the "Tenancy Deposit Scheme" within 14 days,
we also send a letter to ask our landlord where is our deposit, but he never answer it.
We are moving out now nearly 2 months, the landlord still not return our deposit without any reason,we send out formal letter
to our landlord to request our deposit back in 3 weeks ago,but he still not answer back,so we are the only way get the money back
is go to small claim court for our deposit and 3X penalty for the landlord unprotect deposit.
Reply: clutton:the tenancy agreement start on Aug 2009 , and the landlord no reason why not retrun our
deposit,he just not reply our letter, anyway is 2 months now from our moving out date.0 -
I did this through the moneyclaim website (google moneyclaim and it will give you the link)
You do 1 claim for the whole amount and court costs are calculated automatically. You have to pay them upfront and they are added to the judgement if it goes in your favour so you get the money back
Me and my ex LL settled out of court for the deposit which I was more than happy with. for me I just wanted my deposit back, the 3x was merely a scare tactic which worked0 -
if your landlord has no money to pay you it is pretty pointless taking him to court0
