Advice on my photo being used in a comp i didnt know about

Im so sorry as im know this isnt a win but i wondered if you ladys/gents might help.

im a bit miffed with heart fm as i was just entering comp and suddenly my familys picture was in front of me on there site advertising a comp for blenheim palace jousting day. i won this prize of ebay around 4 years ago. we never signed anything for our pictures to be used but we had a few pictures taken by tourist's and the local paper i think. do they have the right to use my pic you think? not going to ask for it to be removed or nothing , just wondering.

    If you didn't sign a model release then no they can't use your picture in marketing material.

  • You'd need to check the terms of the original comp I think. Often it's written in that you agree to your name and pics being used in publicity.

    Maybe it's worth you contacting them to ask them to remove it.

    Often, in the very small print of T&Cs, there is a phrase, something like: Must agree to taking part in reasonable publicity.

    And not necessarily to do with the original comp, so it may well be that they have the right to use the picture because you have technically agreed by accepting the T&Cs at the time.

  • but i brought it on ebay as a charity sale. yeah , its no biggy but was like "omg , theres me" lol
