Natwest not providing Loan Documentation

Hello All,

I am looking for some advise in reclaiming the interest on my loan. I have sent in a standard letter from the site, requesting certified copies of the original loan documents.

I have 2 loans. One completed in branch and the other online. The customer service advisor told me that the loan that was taken out online, is a paperless loan therefore they do not hold records, however i did send back a signed copy to them.

She also stated that according to the credit consumer act - section 77, they are not obliged to provide this information.

I was hoping someone could tell me what my next steps would be if they do not produce or can not produce this documentation?

    Why do you expect to be able to reclaim the interest on the loan. Is it one loan or both that you are trying to reclaim it back on?

    When did you take out the online loan? when did you take out the inbranch one?
    Do you still have outstanding balances on both?

    The reason I want to reclaim on the interest is because i beleive I signed both loans on a lower interest rate then what the current rate is.

    Both loans where taken out in december of 2007 and were for 5 years. There are balances left on both loans as full term is 5 years
  • were they taken on a variable interest rate?
  • no they were both fixed rate loans

    Did you send a letter based on a template from this site to do with unenforcability? they principally deal with pre Apr 07 agreements so you need to be careful that you are quoting correct legislation etc (the requirements changed after April 07).

    That said there should still be a loan agreement and you should still be able to request it.
    Online applications after around 2006 are dealt with differently and they don't actually need to have a customer signature.

    Do you not still have your own copies of the agreements? -well I guess you wouldn't be asking if you had but just in case I'll ask anyway.
