    You've had a goodwill gesture...not an admission of guilt on their part.

    I think the reclaims route has been closed now after the court case hasn't it? Unless you're a 'hardship' case?

    Premier, or Premier Direct account?

    If the latter they'd have sent you an e-mail...since it's an online account. If the former, then I suppose you could argue that 21 days is too long?

    And there wasn't a court case. Just their internal review dept (which, unsurprisingly went in their favour)

    I was referring to the bank charges court case (last year?). You know...the OFT vs the Banks one.

    Even after that though, from one of Martin's articles:


    "2. The charges are disproportionate
    If you unintentionally slipped over your limit by a few pounds and the charge is a lot higher than the ‘offence’ eg you go £1 over but are charged £35.

    The FOS stresses these cases are not "black and white" and those who continually slip over their limit, not in hardship, are not guaranteed to be successful."

    Yeah, looks like that.

    I was hoping someone might have popped up and said "I had a similar problem and did x, y and z and it was resolved"

    I've got an A&L Premier Account and the charges are 50p a day with a max of £5 a month. Are you sure that's the account you've got. It sounds more like a standard account.

    Yeah. They're the charges for overdraft usage.

    The £5 a day are for going OVER the overdraft limit. And there's no cap on it

    Having made a complaint to A&L about this matter, I received a reply, in which is:

    "I can confirm that a status two is applied automatically where an account has exceeded the agreed overdraft facility regardless of the amount of time the account is overdrawn above the agreed limit."

    My credit record says that a status 2 is an account 2 months late or 2 months in arrears. How can this be fair if, by A&Ls own admission, it could just be for the sake of 1 day?

    If the former, tell them (in writing) you're not happy. If the latter, refer it to the FOS.

    Regardless of what they've said in their letter, your case (with the FOS) will be weakened if the transgression did indeed span two statement periods (you haven't yet clarified/confirmed whether this is the case).
